On Thursday, President Joe Biden issued a response to the decision made by the Alabama Supreme Court stating that frozen embryos are considered legally as children.

Biden stated that the recent outcome can be attributed to the reversal of Roe v. Wade, a significant court ruling that had safeguarded the right to have an abortion since 1973.

In the statement, Biden expressed his outrage and disapproval regarding the lack of recognition for women’s autonomy in making decisions for themselves and their families.

The decision is already having an impact in Alabama, with individuals struggling to find alternative options and IVF clinics halting certain procedures. These facilities are now facing higher risks, as patients and doctors may potentially be held accountable for wrongful death or criminal actions related to IVF treatments.

The breaks occurred following a decision by an Alabama court in a case involving the state’s 1872 Wrongful Death of a Minor Act. The lawsuit was filed against a fertility clinic where stored embryos were accidentally destroyed at a storage facility.

After the ruling, three reproductive care facilities in Birmingham ceased offering IVF treatments.

Alabama Fertility Services announced on Thursday that they have made the difficult decision to suspend new IVF treatments, citing legal risks for their clinic and embryologists.

The recent ruling has created a challenge for families in Alabama who do not have any other options for having children. As a result, Gabby Goidel, who was intending to have an egg retrieval, must now seek treatment in another state.

Goidel told The Associated Press, “I was overcome with panic and began to cry. I felt like I was in a state of extreme uncertainty. They were unable to provide all the answers I needed, and I certainly had none myself.”

Despite the closure of certain clinics, others are still offering medical services. According to Dr. Brett Davenport of the Fertility Institute of North Alabama, his facility will continue to offer IVF treatment.

According to Davenport, our actions are extremely supportive of the pro-life movement. Our goal is to assist couples who are unable to have children through traditional means.

He observed that IVF treatment mimics the natural process of conception in a woman’s body, where only a small number of fertilized eggs lead to a successful pregnancy.

Senator Tim Melson, a member of the Republican party, intends to put forward a bill that will protect IVF services. This bill suggests legal safeguards for fertilized eggs after they are implanted, but considers them as “potential life” prior to this stage.

“I’m just trying to come up with a solution for the IVF industry and protect the doctors and still make it available for people who have fertility issues that need to be addressed because they want to have a family,” Melson said.

Skeptics caution about potential consequences, indicating that the decision could discourage fertility specialists from working in Alabama due to concerns about facing legal charges.
