American government organizations are in conversation about which individuals are eligible to evaluate OpenAI, according to Politico.
According to three sources familiar with the situation, Politico reported on Friday that the U.S. Justice Department and Federal Trade Commission are in talks to determine which organization has the authority to investigate OpenAI for potential antitrust violations, specifically regarding its collaboration with Microsoft.
Last year, Microsoft’s partnership with the creator of ChatGPT sparked antitrust concerns due to the software giant’s pledge to invest over $10 billion into OpenAI.
Last month, the European Union’s antitrust regulators noted that Microsoft’s investment in OpenAI could potentially be subject to review under EU merger rules. This comes after a similar caution was issued by Britain’s antitrust regulator in December.
According to the report, the FTC and DOJ have been in discussions for several months to determine which agency has the authority to review the matter. However, neither is willing to relinquish jurisdiction.
According to the report, the discussions primarily focus on Microsoft and OpenAI, and do not involve a wider conversation about which organization will address concerns surrounding artificial intelligence.
When contacted by Reuters, Microsoft refused to provide a statement on the issue.
